HEINSURE INSURANCE BROKERS declare that I understand the requirements and implications of the Protection of Personal Information Act 4 of 2013 and related subordinate legislation (hereinafter referred to as “POPIA”) which came into operation on the 1 July 2021, and in particular, I confirm that I understand that:

  1. The right to privacy is an integral human right recognized and protected in the South African Constitution and in the Protection of Personal Information Act 4 of 2013 (“POPIA”). It aims to promote the protection of privacy through providing guiding principles that are intended to be applied to the processing of personal information in a sensitive manner. Through the provision of quality services, the FSP is necessarily involved in the collection, use and disclosure of certain aspects of the personal information of clients, employees and other stakeholders. A person’s right to privacy entails having control over his or her personal information and being able to conduct his or her affairs relatively free from unwanted intrusions. Given the importance of privacy, the FSP is committed to the effective management of personal information and in accordance with POPIA’s provisions.
  2. The FSP implemented a Protection of Personal Information Policy and the Policy sets out the manner in which the FSP deals with personal information collected, how it is stored and the purpose for which said information is used. This policy is made available by request.
  3. Personal Information is any information that can be used to reveal a person’s identity. Personal information relates to an identifiable, living, natural person, and where applicable, an identifiable, existing juristic person (such as a company), including, but not limited to information concerning: race, gender, sex, pregnancy, marital status, national or ethnic origin, colour, sexual orientation, age, physical or mental health, disability, religion, conscience, belief, culture, language and birth of a person; information relating to the education or the medical, financial, criminal or employment history of the person; any identifying number, symbol, email address, physical address, telephone number, location information, online identifier or other particular assignment to the person; the biometric information of the person; the personal opinions, views or preferences of the person; correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence; the views or opinions of another individual about the person; the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.
  4. Data Subject refers to the natural or juristic person to whom personal information relates, such as an individual client, or a Company that supplies the FSP with Products or Information.
  5. The FSP is a “Responsible Party” and needs the personal information of a Client (Data Subject) for a particular reason and determines the purpose of and means for processing the personal information and needs to deal with the Personal Information of Data Subjects strictly in accordance with the Protection of Personal Information Policy of the FSP.
  6. I also confirm and understand that I must acquaint myself and study this Protection of Personal Information Policy and must at all times strictly adhere to the abovementioned Policy when dealing with the Personal Information of Data Subjects (clients), that the Information Officer explained to me during training, and that I am familiar with the content of this declaration.
  7. I hereby give consent that my own personal information may be collected, processed, used and stored in accordance with the Protection of Personal Information Policy and for the intended purpose for which it has been collected. I hereby understand that it is my responsibility to inform the Information Officer of any changes in my personal information.
  8. I understand that POPIA imposes certain duties, obligations, requirements and/or restrictions on me as a company and I will at all times remain compliant with these requirements.
  9. Failure to comply with any of the POPIA requirements may result in termination of employment and/or debarment after due process has been followed.
